Michael Jackson's life and death back in spotlight in new trial

LOS ANGELES (Reuters) - Almost four years after his shocking death, the bizarre life and sorry demise of Michael Jackson will play out again in a $40 billion civil trial that pits the singer's family against the organizers of a musical comeback that never happened.

Opening statements are set for Monday in what is expected to be an emotional, three-month long jury trial that seeks to hold AEG Live, the promoters of the never-realized series of 2009 London concerts, liable for the wrongful death of the "Thriller" singer.

The lawsuit, brought by Jackson's elderly mother Katherine on behalf of the singer's three children, alleges that privately-held AEG Live was negligent in hiring the physician convicted in 2011 of his involuntary manslaughter to care for the singer while he rehearsed for the series of 50 shows.

Jackson, 50, drowning in debt and seeking to rebuild a reputation damaged by his 2005 trial and acquittal on child molestation charges, died in Los Angeles of an overdose of the powerful surgical anesthetic propofol and a cocktail of other sedatives in June 2009.

His personal physician, Dr. Conrad Murray, is serving a four-year prison sentence after being found criminally negligent by administering propofol to Jackson as a sleep aid.

Murray's six-week trial in 2011 portrayed the former child star known for his stunning dance moves and spectacular public performances as a slurring, drugged-up man off-stage who slept with a toy doll on his bed and whose planned comeback tour was plagued with problems.

The civil trial in Los Angeles is expected to be just as sensational, although a request by TV networks for live coverage was turned down.

AEG Live contends that it did not hire or supervise Murray and claims that Jackson had prescription drug problems for years before entering into any agreement for the "This is It" London concerts.

The concert promoters also argue that they could not have foreseen that Murray posed a danger to Jackson.

SEX ABUSE TRIAL MAY BE REVISITED

Los Angeles Superior Court judge Yvette Palazuelos ruled last month that AEG Live can raise Jackson's 2005 child abuse case as it may be relevant to the singer's history of prescription drug abuse and despondency.

Jackson's two oldest children, Prince, 16 and Paris, 15, are on the witness list this time, although neither testified in Murray's trial. Singers Prince and Diana Ross are also potential witnesses along with the singer's ex-wives, Lisa-Marie Presley and Debbie Rowe.

"Any time you start injecting family members and rather sensitive issues (into the mix), there are going to be strong feelings," former federal prosecutor Marcellus McRae told Reuters.

Murray is not being sued but is also on the witness list, although he has made clear from jail that he will refuse to answer questions for fear of jeopardizing his appeal process.

McRae, now a trial lawyer with Los Angeles firm Gibson Dunn, said that while the criminal trial focused heavily on medical and scientific evidence - including a defense theory that Jackson gave himself the fatal dose of propofol - the jury in the civil case has a very different task.

"The jurors are going to be asked to decide to what extent a third party can be held liable for the actions of someone else.

"To what extent did they (AEG Live) have visibility into what Dr. Murray was doing, did they encourage what he was doing? To what extent was whatever Dr. Murray did a reasonable and foreseeable consequence," McRae said.

Katherine Jackson, 82, and her son's three children are seeking some $40 billion in damages from AEG Live for loss of the singer's earnings and other damages.

AEG Live has argued in court papers that the figure is absurd because Jackson's career was in a downward spiral at the time of his death.

The final amount will be determined by the jury should it hold AEG Live liable for negligence.

Anthony Foxx in line for transportation post

WASHINGTON (AP) ? President Barack Obama on Monday will nominate Charlotte, N.C., Mayor Anthony Foxx as his new transportation secretary, a White House official said Sunday.

If confirmed by the Senate, Foxx would replace outgoing Secretary Ray LaHood.

Foxx is Obama's first black nominee among the new Cabinet members appointed for the second term. The president faced criticism early in his second term for a lack of diversity among his nominees.

The official insisted on anonymity to avoid public discussion of the pick before the official announcement.

The official noted that Foxx has led efforts to improve his city's transit infrastructure to expand economic opportunity for businesses and workers. During Foxx's term as mayor, Charlotte has broken ground on several important transportation projects, including the Charlotte Streetcar Project to bring modern electric tram service to the city as well as a third parallel runway at Charlotte/Douglas International Airport. The city has also moved to extend the LYNX light rail system to the University of North Carolina at Charlotte, the official said.

If confirmed by the Senate, Foxx would take over a department that has been at the center of Washington's debate over the impact of the so-called sequester cuts. The automatic cuts resulted in furloughs for air traffic controllers that helped cause delays at many airports.

Congress reached a deal last week to provide the Transportation Department flexibility that allowed it to end the air traffic controller furloughs.

Foxx, an attorney who has worked in several positions with the federal government, was first elected mayor in 2009. He raised his national profile last year when Charlotte played host to the Democratic Party's convention.

He also served as a member of the Charlotte City Council.

movioraWhenever my friends and I get together for a movie party, the toughest part of the evening is collectively deciding what to watch. There?s always one person that shoots a good suggestion down with a curt, ?I?m not in the mood for that?. Moviora is an app that aims to make that process a little easier. It?s a strange thing. Streaming services like Netflix and Amazon Instant Video certainly provide a plethora of video content for our viewing pleasure, but oftentimes the biggest challenge is narrowing down all of those options to just one title. Netflix offers a list of recommendations by sifting through our viewing history, but it?s far from perfect. I?ve watched a lot of stupid crap, and so have all of my other friends I share my Netflix account with. More often than not, my searching on Netflix will end up in mired in a list of obscure, low-budget B-movie titles that I have no intention of ever watching. Moviora is an app that attempts to discern what we?re in the mood for watching by essentially playing a game of ten questions. For example, it asks if you?re in the mood for a ?drama?, and you narrow the choices down by answering yes or no. Once you?re cycled through these prompts five to six times, you?re provided with a movie recommendation, along with a trailer, some reviews from Rotten Tomatoes, and links to the film on Netflix and iTunes. When I answered ?yes? to drama, ?no? to comedy, ?yes? to romance, ?yes? to action, and ?yes? to adventure, it provided me with Crouching Tiger, Hidden Dragon, which is actually a movie I haven?t watched yet and wouldn?t mind seeing at all. It doesn?t always provide you with the perfect choice, but there?s an addictive quality to the ten questions aspect and it?s certainly a lot better than aimlessly meandering through Netflix?s movie titles. (AP) ? NBA veteran Jason Collins became the first active male player in the four major American professional sports to come out as gay.

The 34-year-old center, who has played for six teams in 12 seasons, wrote a first-person account that was posted on Sports Illustrated's website Monday. Collins finished the season with the Washington Wizards and is now a free agent. He says he wants to keep playing.

"If I had my way, someone else would have already done this," he writes. "Nobody has, which is why I'm raising my hand."

Collins played in a Final Four for Stanford and reached two NBA Finals. His twin brother, Jarron, was also a longtime NBA center. Collins says he told his brother he was gay last summer.

"Jason has been a widely respected player and teammate throughout his career and we are proud he has assumed the leadership mantle on this very important issue," NBA commissioner David Stern said in a statement.

Among those offering support on social media was former first daughter Chelsea Clinton, a friend from Stanford. She tweeted: "Very proud of my friend Jason Collins for having the strength & courage to be the first openly gay player in the NBA."

Collins was also college roommates with another member of an American political dynasty: Rep. Joe Kennedy III, D-Mass. In his account, Collins wrote that he realized he needed to go public when the congressman walked in Boston's gay pride parade last year ? and Collins couldn't join him.

Kennedy tweeted Monday that "I've always been proud to call (Collins) a friend, and I'm even prouder to stand with him today."

Mostly a backup in his career, Collins has averaged 3.6 points and 3.8 rebounds for the Nets, Grizzlies, Timberwolves, Hawks, Celtics and Wizards. He was traded from Boston to Washington in February. Collins was the 18th pick in the first round of the 2001 NBA draft.

Several male athletes have previously come out after they retired, including the NBA's John Amaechi, the NFL's Esera Tuaolo and Major League Baseball's Billy Bean. But Collins is the first to do so while planning to keep playing.

Advocacy organization GLAAD released a statement from Aaron McQuade, who head of its sports program.

"'Courage' and 'inspiration' are words that get thrown around a lot in sports, but Jason Collins has given both ideas a brand new context," he said. "We hope that his future team will welcome him, and that fans of the NBA and sports in general will applaud him. We know that the NBA will proudly support him, and that countless young LGBT Athletes now have a new hero."

Before members rush for airports, Congress ends sequester flight delays

In Congress, it?s a phrase used humorously by staffers and aides hinting that the alluring scent of idling jets has a magical way of speeding up the legislative process when time back in lawmakers? home districts draws near.

On Thursday night and Friday afternoon, however, the Senate and House were literally moved to action by jet fumes: Congress rushed legislation to patch funding for air traffic controllers furloughed by the automatic budget cuts known as the ?sequester? just before jetting home for a week in their states.

The Senate passed the bill without a vote Thursday night. House lawmakers approved the legislation, 361-41, before scampering out of town Friday.

The legislation stopped FAA staff reductions that left planes idling on runways across the country and canceled some flights altogether.

The first impact of the legislation, which White House spokesman Jay Carney told reporters the president would soon sign, would be to stop flight delays (of which there were 6,000 more between Sunday and Wednesday of this week than in the same time last year, according to the air traffic controllers? union) and potentially reopen dozens of rural airports that would have been shuttered by the furloughs.

But it also shows that the Democratic goal of reaching a grand bargain of targeted spending reductions and higher taxes in place of the $1.2 trillion in sequester cuts now mandated over the next decade has some short-term political problems.

Like air traffic controllers, it turns out.

While President Obama wants to find an alternative for all of the roughly $80 billion in sequester cuts this year, Republicans have instead tried to push the responsibility for deciding who gets furloughed or which programs get cut onto Mr. Obama and his executive agencies by giving them discretion?to decide which specific budget items get whacked. The sequester measure,?as it originally passed Congress, required across-the-board cuts.?

Republicans say the executive discretion creates flexibility, and say that the president is playing political games by, as happened this week, air traffic controllers get furloughed when the Federal Aviation Administration could have shifted $253 million from less-vital airport improvement grants to keep them on the job.

Democrats are loath to place responsibility for meting out sequester cuts at the president?s feet for fear of being blamed for reductions they don?t think should happen in the first place.

On Friday, the GOP claimed victory.

Latos outduels Samardzija as Reds edge Cubs 1-0

CINCINNATI (AP) - Todd Frazier gave Mat Latos all the run support he needed, and Latos gave the Cincinnati Reds exactly what they needed to finish off a 10-game homestand in style.

Latos retired the first 10 batters and 15 of the first 16 he faced and mostly spared an overworked bullpen, and Frazier hit a long home run and the Reds beat the Chicago Cubs 1-0 Wednesday.

"This is what we wanted so bad," Reds manager Baker said. "This sets us straight for a couple of days."

With one out in the sixth inning of a scoreless tie, Frazier blasted a 2-1 pitch from Jeff Samardzija 480 feet to straightaway center field to increase his team-leading home run total to six. The homer, which bounced high off the batter's eye, is the longest at Great American Ball Park this season and the seventh-longest in the facility's 11-year history.

"I was just trying to get a fastball," said Frazier, who became the first Cincinnati player to homer in a 1-0 win since Sean Casey against St. Louis on Aug. 26, 2004. "I haven't seen too many lately. I got one, and I took advantage of it. I took a couple of steps and figured it was out, but I didn't know how far until I saw it hit the (batter's eye)."

Latos (1-0), the victim of two blown saves among his first four starts this season allowed four hits and a walk with four strikeouts. He had to rely solely on his two- and four-seam fastballs, too.

It turned out not to be a problem.

"In the bullpen, I had a really good slider and changeup," said Latos, who's strung together 11 consecutive scoreless innings. "I don't know what the hell happened. It's tough. Everybody in the big leagues can hit the fastball. I had to focus on hitting spots, keeping the ball down and away and getting them to hit it on the ground."

Jonathan Broxton replaced Latos with two runners on base and nobody out in the eighth. Both runners moved up on Cody Ransom's sacrifice bunt, but pinch-hitter Alfonso Soriano struck out and shortstop Zack Cozart went deep behind second base to flag down David DeJesus's grounder and throw him out to end the inning.

"I was going to throw it regardless, because there were two outs," Cozart said. "I saw out of the corner of my eye that he wasn't too close to the bag. I've been struggling at the plate lately, so to make a play like that makes you feel pretty good."

Cubs manager Dale Sveum said that's just the way it's been going for the Cubs, who are 1-5 on their current road trip.

"That was an unbelievable play in that situation," he said.

Aroldis Chapman pitched the ninth for his fourth save. Latos's effort left Cincinnati's starting pitchers with a combined 5-0 record and 1.54 ERA on the homestand.

Samardzija (1-4) had his fourth consecutive loss after beating Pittsburgh on Opening Day. The right-hander allowed seven hits and three walks with eight strikeouts and a wild pitch.

The Reds had baserunners in each of the first five innings, including the third, which Devin Mesoraco and Latos led off with singles before Samardzija struck out Shin-Soo Choo, Cozart and Joey Votto - the top three batters in Cincinnati's lineup.

The Reds wrapped up the home stand, one of two of 10 games on their schedule this season, with eight wins despite playing two games that lasted 13 innings, another that went 10, a third that was suspended almost 19 hours from one night to the next day by rain, and Wednesday's game, the start of which was delayed 89 minutes by rain. They won eight games on a homestand of 10 or fewer games for just the sixth time in franchise history and the second in two years. They went 8-2 against St. Louis, Arizona and Milwaukee on a homestand last July.

"This was a weird home stand," Cozart said. "It was a battle every game."

NOTES: A sharp one-hopper by Julio Borbon, the second batter in the game, glanced off Latos's right foot. He recovered to grab the ball and throw Borbon out and stayed in the game after a couple of practice tosses in front of manager Dusty Baker and trainer Paul Lessard. ... Samardzija's effort to catch Choo's bouncer in the bottom of the first left him with a slight cut on his pitching hand, but it quickly closed enough to allow him to continue. ... Choo, who went into the game leading the major leagues with a .535 on-base percentage, has reached base at least once in all 21 of the games he's played this season.

?Upton?s first response was through Twitter. It was only a maybe, but gave Jake more hope for success than the cross-town Los Angeles Clippers ever had. The media soon caught up and Jake was invited for an interview on the Today Show. Discarding formal attire and the first two buttons of the casual plaid shirt he did wear, Jake reminded everyone why he asked Upton (again, a common interest in sports). Then, surprise, Upton came on and stunned Jake with a formal ?I do? to his promposal.

The honeymoon was, as it always is, too short. Upton, once the media hullabaloo subsided, soon reneged. She won?t be going with Jake after all. Publicity doesn?t care whose heart it breaks.

    WHO: New flu passes more easily from bird to human

    BEIJING (AP) ? A lethal new strain of bird flu that emerged in China over the past month appears to jump more easily from birds to humans than the one that started killing people a decade ago, World Health Organization officials said Wednesday.

    Scientists are watching the virus closely to see if it could spark a global pandemic but say there is little evidence so far to show the virus can spread easily from human to human.

    WHO's top influenza expert, Dr. Keiji Fukuda, told reporters at a briefing in Beijing that people seem to catch the H7N9 virus from birds more easily than the H5N1 strain that began ravaging poultry across Asia in 2003. The H5N1 strain has since killed 360 people worldwide, mostly after contact with infected fowl.

    Health experts are concerned about H7N9's ability to jump to humans, and about the strain's capacity to infect birds without causing noticeable symptoms, which makes it difficult to monitor its spread.

    "This is definitely one of the most lethal influenza viruses we have seen so far," Fukuda said. But he added that experts are still trying to understand the virus, and that there might be a large number of mild infections that are going undetected.

    The H7N9 bird flu virus has infected more than 100 people in China, seriously sickening most of them and killing more than 20, mostly near the eastern coast around Shanghai.

    In comparison, the earlier bird flu strain, H5N1, is known to kill up to 60 of every 100 people it infects.

    Wednesday's briefing came at the end of a weeklong joint investigation by WHO and Chinese authorities in Beijing and Shanghai.

    Experts said they still aren't sure how people are getting infected but said evidence points to infections at live poultry markets, particularly through ducks and chickens. They said it was encouraging that reported infections appeared to slow down after the closure of live poultry markets in affected areas.
