ICYMI: Apple's ho-hum environmental report, greener Easter goods ...

Happy almost-April-Fools-Day, readers! The arrival of April means that the much-dreaded Earth Day Onslaught is nigh -- we're still trying to come to terms with how we'll come to terms with the flood of announcements next month, but in the meantime, there are plenty of interesting tidbits to sink your teeth into below (including, if you read to the end, horse meat!). Notable commitments and achievements

? European Union's big emissions pledge: The E.U. this week announced a goal to cut its emissions by 40 percent over 1990 levels by 2030.

? Just in time for Easter, Hershey's released a road map of its progress toward achieving 100 percent certified cocoa by 2020, suggesting that it will be 10 percent of the way to achieving that goal this year, and halfway by 2016.

??Global shipping giant Maersk continues its sustainability work, with an announcement that it is purchasing the biggest ship in the world, which will reduce emissions per container shipped by 50 percent. The move comes after the company announced in January that it had achieved its 2020 emissions-reductions goals -- seven years early -- and has been testing biofuels for shipping voyages since 2011.

? Carbon neutral America's Cup: In preparation for the boating event, taking place in San Francisco later this year, event organizers have created a detailed sustainability plan, including a goal to be a carbon neutral event, through a partnership with Vancouver-based Offsetters.

? Writing the The Guardian, Marc Gunther takes a look at how Disney, Microsoft and Shell are using internal carbon taxes to drive down emissions. (We highlighted Microsoft's efforts at our GreenBiz Forum last month.)

The quest for greener chemicals

For exam?ple, if you have had an unre?lated fall or a car wreck after your work?ers? com?pen?sa?tion acci?dent, the insur?ance com?pany will try to say some or all of your cur?rent issues are because of the unre?lated fall or car wreck and not related to your job injury.

Never mind the fact that they don?t actu?ally have any proof that your cur?rent prob?lem is not related. If they can try to pin your cur?rent prob?lems on some?thing else, they will and they will deny your treat?ment and they will make you have to fight to get your med?ical care restarted.

Look, I?ve been doing this well over 20 years and I?ve seen this hap?pen time and?again.

There are statutes you need to be aware of that can stop your income ben?e?fits, but there are no statutes that ever stop your enti?tle?ment to med?ical care related to your job injury or ever close your case unless you agree to know?ingly and vol?un?tar?ily set?tle your?case.

If the adjuster tells you that your case is closed and you still have med?ical prob?lems related to your job injury, insist that the insur?ance com?pany pay to send you back to the doc?tor. It?s your right under Geor?gia?law.

Pregnant Man: Judge Refuses To Grant Thomas Beatie's Divorce

PHOENIX -- An Arizona judge on Friday refused to grant a divorce for a transgender Arizona man who gave birth to three children after beginning to change his sex from female.

Maricopa County Family Court Judge Douglas Gerlach ruled that Arizona's ban on same-sex marriages prevents Thomas Beatie's nine-year union from being recognized as valid.

Thomas Beatie was born a woman and underwent a double-mastectomy but retained female reproductive organs and gave birth to three children.

Gerlach said he had no jurisdiction to approve a divorce because there's insufficient evidence that Beatie was a man when he married Nancy Beatie in Hawaii.

Beatie is eager to end his marriage, but the couple's divorce plans stalled last summer when Gerlach said he was unable to find legal authority defining a man as someone who can give birth.

"The decision here is not based on the conclusion that this case involves a same-sex marriage merely because one of the parties is a transsexual male, but instead, the decision is compelled by the fact that the parties failed to prove that (Thomas Beatie) was a transsexual male when they were issued their marriage license," he wrote in Friday's ruling.

Gerlach's ruling also said it didn't address whether Arizona law allows a person who was born female to marry another female after undergoing a sex change operation.

The National Center for Lesbian Rights, which isn't involved in the Beatie divorce case, has said courts have declared marriages involving a transgender person invalid in a handful of cases across the country, but that those cases had different factual and legal issues than those in the Beatie case.

Thomas Beatie, known as "The Pregnant Man," was born Tracy Lehuanani Lagondino in Oahu, Hawaii. He began testosterone treatments in 1997 and underwent double mastectomy and chest reconstruction surgery in 2002. He changed his Hawaii driver's license to say he was a man and had a Hawaiian court approve his name change to Thomas.

Gerlach's ruling noted that Thomas Beatie halted the testosterone treatments and that he didn't provide documentation for any additional non-surgical efforts.

Thomas Beatie married his partner Nancy in early 2003 in Honolulu and became pregnant because Nancy was unable to have children. Thomas Beatie conceived with donated sperm and gave birth to children who are now 4, 3 and 2 years old. The couple eventually moved to Arizona.

Beatie has garnered a range of media attention, making the rounds on talk shows such as Larry King and Oprah Winfrey and winning a spot on Barbara Walters' list of "10 Most Fascinating People" in 2008, alongside President Barack Obama, conservative commentator Rush Limbaugh and swimmer Michael Phelps. He also published a book, "Labor Of Love: The Story of One Man's Extraordinary Pregnancy," the cover displaying an image of a shirtless Thomas sporting facial hair and holding a hand over his bare pregnant belly.

From Click to Brick: Ecommerce Redefines In-Store Retail

"Click-to-brick" stores typically fall into of two categories: temporary pop-up stores meant to stir up publicity, such as those launched by Etsy and Birchbox, and permanent showrooms, including ones run by Warby Parker and Bonobos. These permanent locations sometimes do not even have items for sale, thus eliminating the need to carry inventory or invest in a large, expensive retail location.

When he first launched menswear retailer Bonobos, Chief Executive Andy Dunn was wary of the brick-and-mortar concept.

"We were wrong at the beginning," he said. "In 2007, we started the company, and we said the whole world is going online only. All we're going to do is be online."

Since then, the company rolled out their version of the in-person retail store in several locations. The stores are focused on service and do not carry items for sale.

"We think that ecommerce is going to be the flagship store and possibly as much as half of retail for any brand," Dunn added. "But what we've learned recently is that the offline experience of touching and feeling clothes isn't going away. People still want to try stuff on, and so for a brand like ours that's built on fit we want to provide that."

For e-tailers that decide to venture into physical locations, analysts listed several benefits inherent in their business model.

"The advantage they have is that they are omnichannel from the start?they don't have to invest millions in retrofitting their systems to accommodate the web channel," Mulpuru said.

But because their core business is online, it's not always easy also to launch a store, which requires a focus on visual merchandising and a different labor model, she added.

Still, IBM's Puleri said ecommerce stores have the luxury of being nimble since they can change assortment and price on the fly online. But the brands must figure out how to keep their brand in sync across the various channels, she added.

How Many Asiatic Cheetahs Roam across Iran?

How many Asiatic cheetahs still prowl on the planet earth? Compared to their African cousins, the Asiatic cheetah is more imperiled and known to be a critically endangered subspecies. Yet, no reliable estimates of its population are available despite such statistics being required as essential input for conservation and management plans. Despite this, several organizations did not tarry to find answers and to initiate conservation attempts.

The historical distribution of this member of the cat family used to range across diverse ? and vast areas from the Indian subcontinent, Pakistan, Afghanistan and Iran to the Peninsula of Arabia and Syria. In 1977 the last cheetah was recorded in Oman and it is believed that today the Asiatic cheetah?s population is confined to the Iran?s boundary. Observation records show that cheetahs have ceased to roar across the terrains of Saudi Arabia (1973), Pakistan (1972), India (1947), Kuwait (1942) and Iraq (1929), according to Hooshang Ziaie?s Field Guide to the Mammals of Iran.

The evidence pointing towards the cheetahs? extinction from its formerly inhabited regions was strong enough to convince international and national organizations to take an action. In 2001, the United Nation Development Programme (UNDP) and Global Environmental Facility (GEF) funded a four-year conservation project with the budget of $725,000. Iran?s Department of Environment (DoE) also supposed to provide the same amount of budget in kind. However, the project was prolonged for 8 years; and DoE contributed more than the aforementioned tranche. The project, called the Conservation of Asiatic Cheetah and Its Habitat Project (CACP), was assisted by the Wildlife Conservation Society (WCS) and later by the Panthera organization. Additionally, several Iranian NGOs cooperated with CACP, conducting field surveys and enhancing the awareness of local people.

In 2009, a team consisting of Iranian and international consultants evaluated whether the outcomes of project concurred with its original goals of the proposal. The evaluation was difficult for the following reasons: repeated extensions of the project?s duration lasted; related fluctuations in managerial boards of the project (up to evaluation period, both the national and international project directors changed four times each. Changes repeated one more time for both positions after the assessment); a serious dispute over a lack of findings between a contracted Iranian NGO, on one hand, and DoE and UNDP, on the other; difficulties for staff and equipment of WCS, an important scientific partner, to enter the country due to delayed visa issuance; and finally practical problems such as miscommunication between the international and national evaluators in terms of technical language.

Regardless of these problems, however, a consistent issue across the board and mentioned repeatedly in the evaluation report is that the first and most prominent question has not been answered since initiation of the project: what is a reliable estimate of the cheetahs? population in Iran? While answering this formidable question is necessary for the design of a conservation plan, including the setting of priorities and identification of habitat hot spots, it is an arduous effort. The cheetahs? low number, intense shyness, and ability to camouflage make the search for these individuals scattered across the habitats of two vast Iranian deserts akin to finding a needle in a haystack. ?It is assumed that the cheetah population has even increased in recent years, but neither the initial baseline information nor the newest population estimates are reliable enough to assess this assumption?, according to evaluation report.

Some sporadic attempts at camera-trapping have been carried out to estimate the number of cheetahs since CACP began, but none proved to be adequate. ?In ten years of setting out scores of cameras, Iranian researchers have so far managed to obtain a mere 192 fleeting images. Those images document 76 gaunt individuals, pretty much all that remains of a noble subspecies of cheetah that once roamed throughout much of Asia?, writes Roff Smith in a November 2012 National Geographic article.

Dr. Luke Hunger, President of Panthera, the organization assisting the CACP in scientific work, told me: ?incidentally, the most up to date figure is 77 individuals. This is not a population estimate, it is just the total number of known individuals photographed since 2001; most of those animals are now dead.?

In the same month that the issue of National Geographic was published, the director of DoE cited at least 50 individual cheetahs to be living in Iran. Previously, it was presumed that Iran has?a cheetah population revolving around 70-120 individuals, based on Iranian biologists? guesstimations. Subsequently, complementary information about the cheetahs? status has been released. ?Scientific and comprehensive camera-trapping has been conducted in 7 out of 9 cheetah habitats. Preliminarily analysis revealed that at least 50 individual cheetahs exist in Iran,? Hooman Jowkar, the latest national director of CACP, said on a TV broadcast. He, in?a recently published interview, said that just 20 individual cheetahs were identified through 200 images taken by camera-traps. However, this number of individual cheetahs is not representative of the species? total population in Iran.

Dr. Hunter pointed out that the number is uncertain: ?We simply do not have a good estimate of the cheetah?s population. I am worried that the recent camera-trapping results were less positive than in the past, so it is possible the numbers are as low as 50 cheetahs. But we cannot say that for certain. The best we can probably say is somewhere between 50 to 100 individuals.?

Addressing possible reasons for uncertainty in the estimate Jowkar noted in a wildlife conference held in Teheran: ?the focus is just on specific protected areas; and it is not possible to conduct camera-trapping during fall and winter when cheetah is physically most active. Occurrence of livestock in those habitats is the most important challenge. Also, the method should be repeated in the next year in order to produce more reliable results.?

The second phase of CACP had been initiated in January 2009 to run as a four-year project with a budget of $4 million funded by national and international organizations. Recently, it was announced that the project will be extended until 2015. The news brought renewed hope and enthusiasm that not only the population size of the Asiatic cheetah could be scientifically estimated at last, but also that a conservation strategy plan will be compiled. To design and implement such plan could save the cheetah from the blade edge of extinction.

New Soyuz route cuts travel time to ISS from two days to six hours

Normally, a trip from Earth to the ISS takes about two days. Thursday, a Soyuz capsule docked with the orbiting laboratory after less than six hours of flight time, setting a record. Accelerating the trip wasn't an issue of newer technology or more powerful engines, necessarily, but of better math and planning. The Russian vehicle essentially took a shortcut that required precisely timed steering over the course of four orbits, putting three crew members (including one American astronaut) on the space station at 10:28pm ET -- just five hours and 45 minutes after takeoff from Kazakhstan. Russian engineers are already looking at ways to trim more time off the trip, by cutting two more orbits from the route. Obviously the human cargo appreciates spending less time in the cramped quarters of the Soyuz. But getting equipment and materials for experiments to the ISS quicker should also yield better and more reliable scientific results. China: No signs of life in mine landslide

BEIJING (AP) ? No signs of life have been detected at a gold mining site in a mountainous area of Tibet more than 24 hours after a massive landslide buried 83 workers, Chinese state media said Saturday.

The state-run China Central Television said more than 2,000 rescuers have been dispatched to Lhasa's Maizhokunggar county to search for the buried.

About 2 million cubic meters (2.6 million cubic yards) of mud, rock and debris swept through the area as the workers were resting and covered an area measuring around 4 square kilometers (1.5 square miles), CCTV said.

The miners worked for a subsidiary of the China National Gold Group Corp., a state-owned enterprise and the country's largest gold producer. A woman who answered the call at its Beijing headquarters Saturday said she could not provide any information.

The disaster is likely to inflame critics of Chinese rule in Tibet who say Beijing's interests are driven by the region's mineral wealth and strategic position and come at the expense of the region's delicate ecosystem and Tibetans' Buddhist culture and traditional way of life.

The reports said at least two of the buried workers were Tibetan while most of the workers were believed to be ethnic Han Chinese, a reflection of how such large projects often create an influx of the majority ethnic group into the region.

The more than 2,000 police, firefighters, soldiers and medics deployed to the site, about 70 kilometers (45 miles) east of Lhasa, the regional capital, conducted searches armed with devices to detect signs of life and accompanied by sniffer dogs, reports said.

Around 30 excavators were also digging away at the site late Friday as temperatures fell to just below freezing.

The reports said the landslide was caused by a "natural disaster" but did not provide specifics. It was unclear why the first news reports of the landslide came out several hours after it occurred.

China's President Xi Jinping and Premier Li Keqiang ordered authorities to "spare no efforts" in their rescue work, Xinhua said.

Doctors at the local county hospital said they had been told to prepare to receive survivors but none had arrived. "We were ordered to make all efforts to receive the injured," said a doctor who gave only her surname, Ge, in the hospital's emergency section.

On Saturday morning, a hospital staff member who gave her surname of Wu said it had received no one from the landslide, dead or alive.

The Chinese government has been encouraging development of mining and other industries in long-isolated Tibet as a way to promote its economic growth and raise living standards. The region has abundant deposits of copper, chromium, bauxite and other precious minerals and metals and is one of fast-growing China's last frontiers.

Tibet remains among China's poorest regions despite producing a large share of its minerals. A key source of anti-Chinese anger is complaints by local residents that they get little of the wealth extracted by government companies, most of which flows to distant Beijing.

In 2008, unhappiness with Chinese rule spilled over into deadly riots that engulfed Lhasa and an anti-government uprising that swept many Tibetan communities. To quell the unrest, Beijing poured security forces into Tibetan areas and has kept them there since, giving the western China region the feel of a military garrison and further alienating many Tibetans.

In recent years, more than 100 Tibetans have set themselves on fire to protest the stifling security presence and call for greater religious freedom.

Whether you are in a long-term relationship or you're looking for one, you've probably noticed something rather obvious: that not all of us are looking for the exact same things in love relationships. Most of us have unique priorities when it comes to what we value most in this as well as every major aspect of our lives. But certain ingredients that stand the test of time usually characterize the most fulfilling marriages and love relationships. So whether yours is in a difficult period right now, or you simply want to make a good relationship even better, remember the acronym TOUCH:

T stands for tenderness and talking. Tenderness can be expressed both physically and emotionally. Think of this as how you express kindness and caring toward one another. This sounds simple and quite obvious, but isn't always easy when you're in the middle of life's challenges. Communication is also a key. Talk about the issues that concern you; and make it a priority to resolve conflicts before they grow larger.

O is for openness and objectivity. Expressing your thoughts and feelings when they occur can increase intimacy and closeness. Allow yourself to be vulnerable at times. True intimacy is about letting your partner know about parts of you that are most difficult to share. During conflict, being objective can often save the day. It may be easier to stand with your own perspective, but the bigger challenge is taking a step back and looking at your problem almost as if you were a third party. Then, it's much easier to go into problem solving mode. When neither of you are willing or able to do this, you're likely to hit an impasse resulting in more accumulated "baggage" when there's a disagreement.

U is for understanding. This is also known as empathy -- not necessarily agreeing with what your partner is feeling, but knowing and understanding it. Asking questions and showing genuine compassion for what your partner needs can help you know what kind of comfort and support to offer each other.

C is for chemistry and comfort. Who knows how chemistry develops, but it's an ingredient that can lead to great sexual, sensual, emotional, intellectual and spiritual connection. While passion in your relationship is important, so is the ability to be together during the ordinary and mundane moments of daily life. (AP) ? From a young age, no one could tame Evan Spencer Ebel.

His parents sent him to special camps in Utah, Jamaica and Samoa for children with behavioral problems. Neighbors in the middle-class suburbs west of Denver shied away from a kid they described as "a handful."

By age 20, state prison had become Ebel's home. There, he joined a white supremacist gang and ended up in solitary confinement, a place his parents believe soon began to eat away at his already troubled mind.

On Jan. 28, when his term was up, Ebel was set free.

Two months later, he is dead after a shootout with Texas authorities and is a suspect in the death of Colorado's state prisons chief, who was gunned down when he answered the front door of his house. Investigators have said the gun used to in the Texas shootout was the same weapon used to kill Colorado's prisons chief.

Now investigators are trying to piece together whether the final actions of the 28-year-old sprung from his own ideas or came at the direction of a prison gang ? an idea some close to him reject.

His mother, Jody Mangue, says her son was more complicated than news media stories imply.

"He was not a follower by any means," she posted in an online memorial site, suggesting that white inmates are often labeled members of such gangs even if they don't join.

The Colorado Independent website quoted a former inmate and member of the prison gang who said Ebel had left the group and was having a hard time integrating back into society.

"He told me that he needed to release some anxiety," the former inmate, Ryan Pettigrew, told the website, adding the killing did not seem like a gang hit. "He needed that violence as a release so he could calm down. He didn't know any other way."

Ebel's parents haven't returned calls to The Associated Press for comment. But stories from both can be found in an online blog that those close to the family have confirmed the mother wrote, and legislative testimony from the father, who had begged the state to change its solitary confinement rules.

Mangue wrote that her son was an energetic child who accompanied his mother to hand out food and clothes to homeless people in Denver. That energy also was a problem, though. In an earlier online essay, written after visiting her son in prison, Mangue noted that she and Ebel's father began sending their son to camps for troubled youth when he was 12.

"Some people may blame us for what has happened to Evan," she wrote then. "I can only say that his dad and I had to make hard decisions when he was younger hoping to avoid where he is now."

On Jan. 31, 2004, Ebel's younger sister died in a traffic accident, devastating him.

"He was the protective big brother and in this case, was unable to protect her," Mangue wrote. "His life deteriorated after that and he just became numb and lost his direction altogether, between using drugs and committing crimes."

Court records show that Ebel pleaded guilty a few months after his sister's death ? in July 2004 ? to holding a semi-automatic pistol to an acquaintance's head and stealing his wallet while they watched a Denver Broncos game on television. He was first sent to a halfway house. But after being linked to two other armed robberies, he went to state prison.

Corrections officials won't release detailed information about Ebel's prison time, saying the case remains under investigation. But court records show that in 2006, he punched a prison guard in the nose and was convicted of assaulting a corrections official. He was sent to solitary confinement, where he did "Navy Seal type exercises" and read obsessively ? including "War and Peace" several times over, Mangue wrote. Disgusted by prison chow, Ebel became a vegetarian.

Jack Ebel testified before Colorado's Legislature about how solitary confinement changed his son.

"He'll rant a little bit," the elder Ebel told legislators. "He'll stammer. He'll be frustrated that he can't find the words. And I let him get it out, and eventually, because I'm his father, he will talk to me. And I'm convinced, if any of the rest of you were to go talk to him, he wouldn't be able to talk to you."

Jack Ebel also mentioned his son's suffering to Gov. John Hickenlooper, whom he first met when both men worked at an oil and gas firm 30 years ago. They'd stayed in touch even as Hickenlooper launched a career in politics and won the governor's office in 2010.

As he assembled his cabinet, Hickenlooper wooed a deeply religious, data-driven Missouri corrections official to run Colorado's state prisons system. During Hickenlooper's interview with Tom Clements, the Missouri official mentioned his concerns about solitary confinement.

Since Clements came to Colorado in 2011, the number of inmates in solitary confinement has nearly been halved.

"The irony is incredible," Hickenlooper said. "One of the things Tom fought for, we have too many people in solitary confinement with mental disorders, like Evan Ebel."

In January, Ebel was released on mandatory parole ? meaning that even though he'd completed his sentence, he still had to abide by a parole agreement or be thrown back in prison. Corrections spokeswoman Alison Morgan said she couldn't discuss the terms of Ebel's release but that every parolee has to comply with certain personalized requirements, like attending anger management or substance abuse counseling. She said the state also offers parolees help with housing and job placement.

Little is known about Ebel's final two months. However investigators have offered a hint of how he might have gotten the gun used in Texas, even though he was a convicted felon who couldn't legally have one. Colorado Bureau of Investigation agents on Wednesday arrested a suburban Denver woman suspected of legally purchasing a gun and then transferring it to Ebel. Records related to the arrest of Stevie Marie Vigil, 22, were sealed.

It's unclear whether he knew of Clements' reformist goals or just viewed him like many other inmates, as "The Man," as they called whoever ran the prisons agency. It's also unclear if he remained a member of the 211s white supremacist gang that law enforcement officials say he had joined in prison.

On Sunday, March 17, police found the body of Nathan Leon, a father of three who worked as a Domino's deliveryman and had vanished after answering an order that day. Days later, Clements answered the doorbell at his house and was shot in the chest.

Authorities asked people to look out for a dark, late-model car that had been spotted idling outside Clements' house shortly before the shooting. Two days later, a sheriff's deputy in an empty stretch of North Texas pulled Ebel over. Ebel shot and wounded him, and sped off.

Authorities gave chase. Ebel peppered them with gunfire before crashing his 1991 Cadillac into an 18-wheeler hauling gravel near the town of Decatur.

Three deputies surrounded him, but he left his wrecked vehicle and opened fire. The deputies shot back. Ebel was hit in the head and died at a Fort Worth hospital. He had bomb-making equipment, instructions and other plans in his car, but it's not clear where he was going.

One thing was clear, said Decatur Police Chief Rex Hoskins: "He wasn't planning on being taken alive."

(AP) ? Documents released Wednesday detailing the shooting of former Rep. Gabrielle Giffords show how the gunman had grown increasingly erratic and delusional in the months leading up to the rampage as he alienated friends and family and became paranoid that police were out to get him.

The roughly 2,700 pages included witness and survivor accounts from people who helped save Giffords' life after she was shot in the head outside a Tucson supermarket in 2011 during a meet-and-greet with constituents. Six people were killed and 11 others were wounded.

The files also provide the first glimpse into gunman Jared Lee Loughner's family. His parents have said nothing publicly beyond a brief statement after the attack, but records show they were trying to deal with a son who had grown nearly impossible to communicate with.

"I tried to talk to him. But you can't. He wouldn't let you," his father, Randy Loughner, told police. "Lost, lost and just didn't want to communicate with me no more."

"Sometimes you'd hear him in his room, like, having conversations," said his mother, Amy Loughner. "And sometimes he would look like he was having a conversation with someone right there, be talking to someone. I don't know how to explain it."

Randy Loughner said his 24-year-old son had never been diagnosed with mental illness. Despite recommendations from officials at Pima Community College, which expelled Loughner, that he undergo a mental evaluation, his parents never followed up.

However, Loughner's parents grew worried enough about their son that they drug tested him.

The results were negative, said Amy Loughner, who was particularly worried that her son might have been using methamphetamine.

She said Loughner had told his parents that he had not had a drink of alcohol in five months but that he had tried marijuana and cocaine in the past.

The father said his son kept journals, but they were written in an indecipherable script.

Several weeks before the shooting, Loughner visited Anthony George Kuck, who had known him since preschool. Kuck said he was alarmed to find he had shaved his head and was armed with a handgun.

"I kicked him out of my house because he showed me his gun," Kuck told police, adding that Loughner said he bought it for protection.

"I tried to talk to him about why it's not smart to have a gun," Kuck said. "He obviously didn't listen to me."

Kuck told police he had seen Loughner's mental state deteriorate over time, starting with drinking problems in high school, trouble with authorities and being kicked out of college, noting Loughner had gotten tattoos of bullets and a gun on his shoulder.

"I know he has some crazy thoughts where he ... just believes the government is corrupt, and he has all these assumptions on things, that he doesn't really know what he's talking about," Kuck told investigators.

While he never heard him mention Giffords "he just seemed to have some kind of ... hate for government," Kuck added.

Kuck's roommate, Derek Andrew Heintz, who has known Loughner since he was about 12, said he was cooking when Loughner showed up with a gun and removed it from his belt. It was loaded with 32 rounds.

He asked Loughner why he had the weapon. "There's no need for it here," Heintz told him.

"I just want to show you,'" Loughner replied.

Loughner then left Heintz with a souvenir ? one bullet.

On the day of the Jan. 8, 2011, shooting, a friend, Bryce Tierney, told investigators Loughner called him early in the morning and left a cryptic voice mail that he believed was suicidal.

"He just said, 'Hey, this is Jared. Um, we had some good times together. Uh, see you later.' And that's it," Tierney said.

He recalled for detectives a time when Giffords visited Pima Community College, where the two attended classes together.

Loughner asked her, "What is government and stuff?" Tierney said. "She couldn't give him the answer. ... I feel like he had ... something against Gabrielle Giffords."

Tierney also described Loughner's apparent spiral into madness, saying his behavior was growing strange "in a dark way." He said Loughner would send him text messages that he called "nihilistic ... the belief in nothing."

Onetime Loughner friend Zachary Osler also described the shooter's increasing isolation from his other friends and acquaintances in the years leading up to the shooting.

He explained how he worked at a sporting goods store where Loughner bought the Glock 9 mm handgun used in the shooting. He was questioned about seeing Loughner shopping there, sometime before Thanksgiving, and described his awkward encounter with the man.

"His response is nothing. Just a mute facial expression. And just like he, he didn't care," Osler told authorities.

Osler also told investigators he had grown uncomfortable with Loughner's strange personality.

"He would say he could dream and then control what he was doing while he was dreaming," Osler said.

Still, he said he was shocked to learn Loughner had carried out such an attack.

"And I was like, 'I know this person. Why would he do it? What would his motive be?'" he added, noting that Loughner had never mentioned Giffords in the past.

When he was arrested at the scene, Loughner was wearing peach-colored foam earplugs, authorities wrote in the documents. He was polite and cooperative as detectives began their hours-long initial interview.

As Loughner sat in restraints in an interview room, the conversation was confined mainly to small talk. Little was said over the first four hours. Loughner asked if he could use the restroom, then at one point complained he felt sore.

"I'm about ready to fall over," he said.

Giffords intern Daniel Hernandez described how constituents and others were lining up to see Giffords that morning. He helped people sign in and recalled handing the sheet on a clipboard to Loughner.

"The next thing I hear is someone yell, 'Gun,'" said Hernandez, who rushed to tend to Giffords' gunshot wound to the head.

"She couldn't open her eyes. I tried to get any responses from her. It looked like her left side was the only side that was still mobile," Hernandez told authorities. "She couldn't speak. It was mumbled. She was squeezing my hand."

Hernandez explained how he had some training as a nurse and first checked for a pulse.

"She was still breathing. Her breathing was getting shallower," he said. "I then lifted her up so that she wasn't flat on the ground."

The documents detailing the event and ensuing investigation had been kept private until being released by the Pima County Sheriff's Department.

News organizations seeking the records were repeatedly denied access in the months after the shooting and the arrest of Loughner, who was sentenced in November to seven consecutive life sentences, plus 140 years, after he pleaded guilty to 19 federal charges.

Last month, U.S. District Judge Larry Burns cleared the way for the release of the records after Star Publishing Company, which publishes the Arizona Daily Star in Tucson, sought their release. The judge said Loughner's fair-trial rights were no longer on the line now that his criminal case has resolved.

Loughner's guilty plea enabled him to avoid the death sentence. He is serving his sentence at a federal prison medical facility in Springfield, Mo., where he was initially diagnosed with schizophrenia and forcibly given psychotropic drug treatments.

Arizona's chief federal judge and a 9-year-old girl were among those killed in the rampage. Giffords was left partially blind, with a paralyzed right arm and brain injury. She resigned from Congress last year and has since started, along with her husband, a gun-control advocacy group.

The Star said it wanted the records because they contain information about how a mass shooting occurs, including how long it took Loughner to fire gunshots ? an issue raised by some advocates in the debate over high-capacity pistol magazines.

Phoenix Newspapers Inc., which publishes The Arizona Republic, and KPNX-TV had joined Star Publishing in the latest effort to get the records released after The Washington Post's initial request was denied in March 2011.

Proximity to coal-tar-sealed pavement raises risk of cancer, study finds

Mar. 28, 2013 ? People living near asphalt pavement sealed with coal tar have an elevated risk of cancer, according to a study in the journal Environmental Science and Technology. Much of this calculated excess risk results from exposures in children, age six or younger, to polycyclic aromatic hydrocarbons (PAHs) from the sealant.

"The increased cancer risk associated with coal-tar-sealed asphalt (CSA) likely affects a large number of people in the U.S. Our results indicate that the presence of coal-tar-based pavement sealants is associated with significant increases in estimated excess lifetime cancer risk for nearby residents," said E. Spencer Williams, Ph.D., principal author of the study and Baylor University assistant research scientist at the Center for Reservoir and Aquatic Systems Research in Baylor's College of Arts & Sciences.

Researchers from Baylor University in Waco, Texas, and the in Austin, Texas, are the first to report on the potential human health effects of PAHs in settled house dust and soil in living spaces and soil adjacent to parking lots sealed with coal-tar-based products.

"Exposure to these compounds in settled house dust is a particularly important source of risk for children younger than six years of age, as they are expected to ingest this material at higher rates," Williams said. "This indicates that the use of coal-tar-based pavement sealants magnifies aggregate exposures to PAHs in children and adults in residences adjacent to where these products are used and is associated with human health risks in excess of widely accepted standards."

Data on PAHs in settled house dust used for this analysis were published previously by the same authors. In that study, settled house dust and parking lot dust were sampled for 23 ground-floor apartments in Austin, Texas. The parking lot surfaces adjacent to the apartments were coal-tar-sealed asphalt, asphalt-based sealant over asphalt pavement, or unsealed concrete. Concentrations of PAHs were 25 times higher in house dust in residences adjacent to coal-tar-sealed pavement compared to those with other pavement types. "This study was the first to find a strong association between a product or a behavior and PAHs in house dust," said Barbara Mahler, the USGS research hydrologist who oversaw the study.

For this study, doses and risk associated with residences adjacent to unsealed asphalt lots were considered relative to those adjacent to (CSA) parking lots. Benzo(a)pyrene concentrations in CSA-affected settled house dust were high relative to those reported in most parts of the U.S. where coal-tar-based sealcoat is not used (California and Arizona). Data for PAHs in coal-tar-sealed asphalt-affected soils and unsealed asphalt-affected soils are available from samples from New Hampshire and suburban Chicago.

The analysis did not consider exposure to the dust on the pavement itself, which has PAH concentrations 10s to 100s of times higher than those in house dust or soil, or inhalation of air over sealed pavement. "Over time, about half of the PAHs in the sealcoat are released into the air, and concentrations in air are extremely high, particularly in the hours to days after application," said Peter Van Metre, USGS research hydrologist and author of two papers on volatilization of PAHs from sealcoat.

Sealcoat is a black, shiny substance sprayed or painted on the asphalt pavement of parking lots, driveways, and playgrounds to improve appearance and protect the underlying asphalt. An estimated 85 million gallons of coal-tar-based sealant are applied to pavement each year, primarily east of the Continental Divide in the U.S. and parts of Canada. Coal-tar-based pavement sealants are 15 to 35 percent coal-tar pitch, which has been classified as a human carcinogen by the International Agency for Research on Cancer. Over time, the dried sealant is worn away from pavement surfaces, and the resulting mobile dust particles can be transported into nearby homes.

"Although the analysis presented here is based on a limited dataset, the results indicate that biomonitoring might be warranted to characterize the exposure of children and adults to PAHs associated with coal-tar-based pavement sealant," Williams said. "Further investigation is also needed into the impacts of coal-tar-based pavement sealants on PAH concentrations in indoor and outdoor environments."

Forecast: Twitter's ad revenue to double this year

(AP) ? A research firm expects Twitter's ad revenue to double this year as the online messaging service delivers more marketing pitches aimed at consumers using smartphones and tablet computers.

In a report issued Wednesday, eMarketer projected that Twitter's worldwide ad revenue will climb from an estimated $288 million last year to $583 million this year. In 2014, eMarketer predicts Twitter's ad revenue will approach $1 billon.

EMarketer believes mobile devices will account for more than half of Twitter's ad revenue this year.

The research firm makes educated guesses about Twitter's revenue based on market trends and data. Twitter, based in San Francisco, is privately held and doesn't disclose financial figures.

Twitter hasn't set a timetable for an initial public offering of stock.

Three more charged in insider trading probe

NEW YORK (Reuters) - Federal prosecutors announced criminal charges on Tuesday against three new defendants in the government's broad-based insider trading probe.

Authorities said David Riley, a former chief information officer at Foundry Networks Inc, leaked tips about the company's pending $3 billion takeover in 2008 by Brocade Communications Systems Inc , to hedge fund analyst Matthew Teeple.

The government said Teeple then tipped others, resulting in trades that led to more than $27 million in profits and avoided losses.

Teeple was an analyst at Artis Capital Management, a San Francisco-based hedge fund launched in 2001 that invests mainly in public technology companies, according to people familiar with the matter.

"Artis has been cooperating fully with the government's investigation into this matter and has been advised by the U.S. Attorney's Office that the firm is a witness in the investigation," Bill McBride, a spokesman for the firm, wrote in an email.

Prosecutors said Teeple had also leaked information to Karl Motey, a California technology consultant who has pleaded guilty in the probe and been cooperating with prosecutors, the government said.

Riley, 47, and Teeple, 41, were each charged with three counts of securities fraud and one count of conspiracy, U.S. Attorney Preet Bharara in Manhattan said. They face up to 20 years in prison on each securities fraud count.

A third defendant, John Johnson, 46, pleaded guilty to one count each of securities fraud and conspiracy, Bharara said.

Johnson is the chief investment officer of the Wyoming Retirement System, which he joined as a senior investment officer in 2010, after the allegations in the complaint. The pension on Tuesday relieved him of all his investment and administrative responsibilities pending further review, according to Tom Williams, executive director.

Johnson had had various contacts with Teeple since 2005, when Johnson worked at a mutual fund, and made more than $136,000 on trades based on information about the Foundry takeover leaked to him by Teeple, prosecutors said.

Johnson told Williams about the charges Tuesday afternoon, Williams said.

"To the extent that these charges are true, we're very disappointed," Williams said.

All three defendants were also charged in separate U.S. Securities and Exchange Commission civil proceedings.

"When David Riley and Matthew Teeple chose to traffic in inside information involving high-tech companies, they embarked on a high-stakes game that has repeatedly proven to be unwinnable," Bharara said in a statement.

Nathan Hochman, a lawyer for Teeple, said his client intends to defend himself against the charges.

John Kaley, a lawyer for Riley, did not immediately respond to requests for comment. Joshua Franklin, a lawyer for Johnson, declined to comment.

Riley and Teeple were arrested on Tuesday morning in California and were expected to appear later in the day in different federal courts in that state.

ARTIS INVESTED IN YOUTUBE

The arrests are the latest in a widespread government crackdown on insider trading in recent years.

Since October 2009, the Manhattan U.S. Attorney's Office has charged at least 80 people, of whom at least 72 have been convicted or pleaded guilty.

Launched in 2001 by Stuart Peterson, Artis is known for having co-invested alongside Sequoia Capital in an $8 million round of financing in video-sharing website YouTube, before it was sold to Google Inc for $1.65 billion in 2006.

Artis is not named in court papers made public on Tuesday about the latest criminal charges.

Motey avoided prison time at his sentencing in February, at which a federal judge called him "a particularly impressive cooperator." He was ordered to submit $40,000 and serve a year of supervised release for conspiracy and securities fraud.

Motey kept a notebook "he often used to memorialize conversations he had with various individuals, including Teeple," the complaint states. Motey told investigators that a July 18, 2008, entry summarized a conversation in which Teeple explained that the Foundry acquisition might happen at $2.9 billion, according to the complaint.

Teeple also provided information about Palm Inc to Motey and Riley in exchange for the inside information on Foundry, according to the complaint.

In a June 15, 2009 telephone call that Motey recorded, Teeple said his firm owned "like 12 million shares" of the device maker, and that it was "gonna be a monster for a while."

When Motey asked Teeple where in Palm his contacts were, he said "one guy is in dev and then, one guy is kind of a, senior marketing guy," according to the complaint.

The cases are U.S. v. Riley et al, U.S. District Court, Southern District of New York, No. 13-mag-00806; U.S. v. Johnson in the same court; and SEC v. Teeple et al in the same court, No. 13-02010.
