Samsung/Apple trial by jury begins today, don't expect a clear outcome anytime soon

Following months of legal wrangling, injunctions and appeals, Samsung and Apple will face off in a federal court in San Jose today. The two companies accuse each other of patent and design infringement, with Apple seeking more than $2.5bn in damages, and Samsung looking to claim royalties for five of its own patents.

The narrative is all too familiar -- Apple accuses Samsung of being a "copycat" and imitating its products and inventions rather than coming up with its own stuff. Samsung counters that Apple's claims are overly broad, and that its actions are anti-competitive and monopolistic.

Apple will argue that Samsung has copied its patented designs, and that Samsung's products, in both hardware and software, are "confusingly similar" to the iPhone and iPad. It's a tactic which has been met with some success, notably in the German courts, over the past year. However, it's backfired in the UK, where a High Court judge recently ruled that Samsung did not copy Apple's iPad designs, and ordered Apple to take out ads to this effect.

So we're in for yet more claims and counterclaims, with the certainty of appeals to follow whatever verdicts the court reaches. So strap yourself in, and prepare for endless back and forth lawyerin' over the coming weeks. As our own Jerry Hildenbrand noted in his recent editorial, this is just the way things have to be in the mobile tech world in 2012. Let's just hope that whatever the decision, it doesn't impact consumers' freedom to choose the phone they want.

US judge strikes down EPA water rules for mines

CHARLESTON, W.Va. (AP) ? The Environmental Protection Agency overstepped its powers by setting up water-quality criteria for coal mining operations in Appalachia, a federal judge ruled Tuesday.

U.S. District Judge Reggie B. Walton in Washington ruled in a lawsuit filed by a coal mining industry coalition against the EPA and Administrator Lisa Jackson. The judge said the EPA infringed on the authority given to state regulators by federal clean water and surface mining acts.

Last year the EPA revised standards issued in April 2010 by tightening guidelines on the practice of dumping waste from surface mine blasting into Appalachian valley waterways.

The EPA had written that the fundamental premise of its new guidelines was that "no discharge of dredged or fill material may be permitted" under any of three conditions: if the nation's waters would be "significantly degraded"; if it causes or contributes to violations of a state's water quality standard; or "if a practicable alternative exists that is less damaging to the aquatic environment."

The National Mining Association, one of the plaintiffs, denounced the guidelines as a "jobs destroyer" and hailed Walton's decision.

"It is now time to get miners back to work by allowing the state permitting agencies to do their jobs," the association said in a statement.

West Virginia Environmental Protection Secretary Randy Huffman commended the judge "for doing the right and obvious thing."

"We knew when this first draft guidance document came out that it was wrong, that it was an illegally promulgated document," Huffman said. "We had no doubt we were going to win from the very beginning. We're not down here high-fiving one another. We knew that there was no other decision to be made."

In 2011, aides for then-Gov. Joe Manchin filed a similar lawsuit targeting EPA policies adopted since President Barack Obama took office that are designed to limit the practice of burying streams under excess rock removed while extracting coal at mines.

Critics say that practice destroys the environment. The mining industry defends it as an efficient way to produce cheap power and employ thousands in well-paying jobs.

West Virginia's lawsuit was consolidated with the National Mining Association's complaint.

Manchin, now a U.S. senator, called it a "great day for West Virginia."

"I remain hopeful that this court decision will put us on the path of getting the permits that we need to provide energy and jobs not just for West Virginia, but for this entire country," he said. "Looking ahead, I will work to make sure the EPA understands that it needs to work as an ally, not an adversary."

Last year, Walton sided with the National Mining Association in its challenge of a 2009 decision in which the EPA and the U.S. Army Corps of Engineers agreed to coordinate reviews of backlogged permit applications for waste disposal at Appalachia mountaintop mining operations that raised serious environmental concerns.

And in March, another federal judge declared valid water pollution permits that the EPA had revoked for one of West Virginia's largest mountaintop removal coal mines. The U.S. Army Corps of Engineers had issued the permits for the 2,300-acre Spruce No. 1 mine in Logan County.

Janet Keating, executive director of the Huntington-based Ohio Valley Environmental Coalition, said Walton's latest ruling was "a shame."

"What's really at stake is our water," Keating said. "Everybody needs clean water. I think the EPA is here to protect us all and not any one single industry's interest."

A message left with the EPA wasn't immediately returned.

To take advantage of that effect, I added jalapeno slices to infuse heat and aroma into the watermelon.

If you?ve ever vacuum sealed food with liquid before, you?ll know how annoying it is.? As the juices are pulled out of the bag, it prevents the heat seal from adhering.? I learned that if I put a paper towel near the bag?s opening before sealing, it?ll soak up any excess liquid and allow the bag to seal properly.

After experimenting with several combinations, my friends agree that I?ve nailed it on this one.? Avocado slices contributes butteriness while the feta and capers adds complex brininess.? The?piquant red onion and fresh mint leaves brightens whole salad.? A drizzle of good olive oil and a sprinkle of coarse sea salt ties the unconventional flavours together.

If you don?t have time or the equipment to compress the watermelon, weighing it down for an hour as mentioned above helps a lot.

As a bonus, here?s a super quick and painless appetizer idea.? I actually threw this together as an post-work snack so it?s not the prettiest but it sure was delicious.? Layer a jalapeno slices, basil leaves, and mozzarella cheese onto watermelon cubes.? Sprinkle with pink salt and enjoy.

Quick and painless watermelon appetizer with jalapeno, basil, and mozzarella

Jalapeno compressed watermelon salad

Yield: 4 servings

Ingredients

  • 1 watermelon
  • 2 jalapeno peppers, sliced
  • 1/2 red onion, sliced thinly
  • 1 avocado
  • 1 cup feta cheese, crumbled
  • 1/3 cup capers, drained
  • 1 bunch mint leaves
  • 1/3 cup good olive oil
  • coarse sea salt and freshly ground pepper

Directions

  1. Remove the watermelon\'s and cut the flesh into 1 inch slabs. A 8X8 inch slab should be enough for each person. It is fine to have smaller slabs.
  2. Place the slabs into several vacuum seal bags. Do not overlap. Spread the jalapeno slices over the watermelon. Roll up a sheet or 2 of paper towel and place it into each bag. Vacuum seal the watermelon. The paper towel should soak up much of the juice.
  3. Place the bags into the fridge for an hour. Now is a good time to chill 4 salad plates too.
  4. To assemble, cut the bags open and discard the jalapeno slices. Cut the watermelon into the desired size and shape. I usually cut them into squares but it is up to you.
  5. Divide the compressed watermelon slices among 4 salad plates. Divide and top with the red onion, avocado slices, feta cheese and capers.
  6. Drizzle on the olive oil, season with sea salt and pepper. Garnish with fresh mint leaves and serve.

First Pisa, now Rome's Colosseum - it's leaning

ROME (Reuters) - The ancient Colosseum of Rome, where gladiators fought for their lives, is slanting about 40 cm (16 inches) lower on the south side than on the north, and authorities are investigating whether it needs urgent repairs.

Experts first noticed the incline about a year ago and have been monitoring it for the past few months, Rossella Rea, director at the 2,000-year-old monument, said in an article published in the Italian daily Corriere della Sera on Sunday.

The Leaning Tower of Pisa, another of Italy's most popular attractions, was reopened in 2001 after being shut for more than a decade as engineers worked to prevent it from falling over and to make it safe for visitors.

Rea has asked Rome's La Sapienza University and environmental geology institute IGAG to launch a study on the phenomenon, with investigations to be concluded in a year.

Tests have also started to observe the effects that traffic on nearby busy roads may have on the monument.

Professor Giorgio Monti, from La Sapienza's construction technology department, warned there may be a crack in the base below the amphitheatre.

"The slab of concrete on which the Colosseum rests, which is like a 13-metre (yard)-thick oval doughnut, may have a fracture inside it," he told the newspaper.

He said intervention could be necessary if the concerns are confirmed, along the lines of stabilization work carried out in Pisa, but he said it was too early to judge what kind of intervention would be most suitable.

The Colosseum - famous for hosting bloody gladiator fights in the days of the Roman Empire - attracts hundreds of thousands of tourists and is usually packed with visitors.

It's based on a poem by William Blake, which wonders whether there is truth to the legend that Jesus visited England as a young man: ("And did those feet, in ancient time; walk upon England's mountains green?") Blake ? like Boyle ? contrasts that with a bleaker nation of industrialized "dark Satanic mills," before calling - "Bring me my chariot of fire!" for a new heaven to be built "in England's green and pleasant land."

TELEVISION GENERATION

Ask Britons from 6 to 60 about their favorite TV show and one answer will probably dominate: "Doctor Who." The series about a space-hopping Time Lord first aired in 1963; so far 11 actors have played its lead character, an enigmatic alien known only as "The Doctor." The show fuses science fiction thrills with humanism and whimsy and is vital suppertime viewing for millions. It's also an Olympic in-joke: West Ham, an east London team, is bidding to move into the Olympic Stadium once the games are over.

GREAT MOMENTS IN BRITISH WEATHER

Of course Britain's weather HAD to figure in a show about an island nation, with references to BBC radio's daily institution "The Shipping Forecast." Though it provides crucial data for mariners, the forecast is admired for its melodic and soothing chant four times a day. It's a reminder that even in the jet age, Britain is an island nation where much depends on the movement of the sea.

Boyle also pokes fun, reminding the audience of the moment when BBC weatherman Michael Fish assured his audience that a hurricane would bypass Britain's shores. Alas, it did not. The Great Storm of 1987 was the most severe to hit the nation for centuries.

And I agree?producing a video never goes as quickly as writing a blog post or a tweet. For some, just uploading a video will require a whole new set of skills.

But with high investment comes great reward. A video will set you apart from your competitors not just because you are better but because the audience will feel they know you. And when they know you, they?ll like you, right? As long as you take the following steps:

1. Use a good microphone. Even more important than good quality video is good quality audio. If the viewer can?t understand what you are saying ,they certainly aren?t going to stick around to watch. Amateur video can be forgiven, amateur sound can?t.

2. Explain something. Give the viewer a reason to watch your video, whether it?s instructive, gives an ?insider look?, or is just funny. Don?t just make video so you can say you make video.

3. Go for quality. One well-written and produced video will go much farther than 10 lame ones. Some people disagree with my quality over quantity stance but with the masses of content out there, I think quality is the only way to cut through and catch a potential client?s eye.

So here are some ideas for small business videos?

? The Wedding Florist: hire a small production crew for a half-day to come to your workspace. With some pre-production planning, 5 simple videos could be filmed to demonstrate how you create 5 different kinds of bouquets. Don?t worry about people stealing your techniques?by establishing yourself as an expert AND accessible, your brand will grow.

? The Local Restaurant: show how kid-friendly you are by interviewing a cross-section of young patrons about their favorite meal on the menu. Just be sure to ask them, ?What do you like to eat here and why is it so yummy?? not, ?Do you like the food here?? so you don?t get ?yes? or ?no? (God forbid) for an answer. Edit them together and you?ve got adorable video gold.

? The Web Designer: get a friend to interview you about your influences and the aesthetics you feel set your website designs apart from other designers. Over the edited interview, lay in screen-shots of the sites you?ve designed to show potential clients just what you mean and are capable of.

Every video is about telling your story with pictures. So remember to let the visuals do the talking when you can.

Star's sleep disorder shuts down 'Fringe'

Production on Fox's sci-fi drama "Fringe" has been shut down for two weeks due to the illness of star John Noble.

Comic-Con 2012: 'Fringe' cast bids a tearful goodbye, reflects on five seasons (video)

A source with knowledge of the situation tells The Hollywood Reporter that the 63-year-old Noble, who plays scientist Walter Bishop on the show, is being treated for a sleep disorder. Noble's illness effectively shut down filming on the fifth and final season on Tuesday -- just one day after he was expected to appear on the Television Critics Assn. press tour panel with Anna Torv, Joshua Jackson, Lance Reddick and showrunner J.H. Wyman.

The delay was initially said to be only three days, but sources now say it will be extended to nine shooting days, until about Aug. 7.

Noble's absence was addressed during the Fringe session at the Television Critics Association gathering on Monday, with Wyman telling reporters that the actor was "under the weather."

Filming on the season five premiere began last Wednesday in Vancouver and continued Thursday and Friday. Production on the series was paused Monday so cast members could attend TCA.

Separately, on Tuesday a source confirmed to THR that production had been impacted by co-star Jasika Nicole's car accident, in addition to multiple illnesses in the cast.

The extended delay is not expected to impact the series' Sept. 28 premiere date.

The news comes after castmates and Wyman publicly lauded Noble, who appeared at Comic-Con on July 15, for his work on "Fringe" and discussed his Emmy snub for his complicated performance on the sci-fi series.

TRU iTArm Articulating iPad & Tablet Arm

While I was testing it, I had a lot of people stop and ask about the iTArm, an articulating arm that holds your tablet in nearly any position imaginable. Most were intrigued, but almost all balked at the $99.95 (list) price. The iTArm is an interesting concept, and offers some genuine usefulness for tablet owners, but I never felt completely safe leaving my tablet in the iTArm, and the price is too high.

The iTArm has an industrial look to it that resembles some older articulating desk lamps. A system of interconnected springs and metal arms, with a vice-grip-like base, extend and rotate the arm to various heights and depths. The arm extends to 34.7 inches, which makes it a large addition to your desk or work area. At the end is an adjustable plastic tablet cradle, with two padded tabs on each end and a padded back. The width and depth of the padded tabs are adjustable, but the fit was a little loose for thinner tablets like the Apple iPad?($499, 4.5 stars). The padding itself, while soft, lacks sufficient grip, and I was able to slide several tablets out of the cradle without disengaging the locking mechanism. I tested with the aforementioned iPad, a Lenovo IdeaTab S2109?($399, 2.5 stars), and an Asus Transformer Pad Infinity TF700?($499, 4 stars). Of the three, the IdeaTab fit best, but only because of its larger and thicker frame.The plastic of the tablet cradle was not very stiff either, and the flex only adds to the somewhat insecure fit. In my tests, a quick screen swipe or poke would leave the iTArm shaking for a few seconds.?

The iTArm is a novel idea, but the execution is off. I tested with a number of tablets, and while they fit in the iTArm, I wasn't completely confident in the cradle's grasp. Rotating the cradle 90 degrees creates a very insecure hold, and a few tablets slipped out of the cradle when rotated to portrait mode with the pads on the sides and not the top and bottom. When it works correctly, the iTArm does improve the ergonomics of tablet use, helping to reduce the neck and shoulder strain that comes from hunching over for long periods. I just wish the fit was more secure?especially given the $100 price.

Same Sex Marriage: What This Writer Thinks ? Family Scholars

Since David?s piece appeared several weeks ago there?s been a lot of discussion and reaction. As he was writing the piece David conversed with many of his friends, including me, so I was not at all surprised when it was published. I respect deeply the way he has engaged this topic over the years, his sincerity, his courage, his doggedness, and his willingness to listen. I respect that the piece he wrote several weeks ago was the result of much careful thought. It was also a beautifully and carefully written piece that bears many re-readings.

In the weeks since his piece appeared, I?ve been thinking about what I think about all this. I decided to wait to write something until someone asked me. Today, a friend of the Institute asked me what I think. So now I?ll write a few words.

I still do not support legalization of same sex marriage. I am skeptical and cautious about redefining marriage in this way, because of the unintended consequences I see for the culture, for how legalizing same sex marriage redefines parenthood and weakens understandings of the importance of mothers and fathers in children?s lives. I will continue to research, write, speak about and mentor younger scholars on this topic. My goal as always is to be careful and compassionate as I do so.

At the same time, I will also continue to give attention to other important marriage debates today that are directly affecting many more children, especially in the broad middle of America. I am referring here to the roughly 60 percent of young adult Americans who have high school but not college degrees, more than half of whom are now having children outside of marriage. I will be researching, writing, speaking about, and mentoring younger scholars on the risks for those children and families and what we as a nation can do to help.

As I have said before, I do support adoption access for gay and lesbian would-be parents and use of second-parent adoption to strengthen these families. I support protections for gays and lesbians not to be discriminated against in child custody decisions after a divorce or breakup. I do recognize that gay and lesbian persons are and will continue to be raising children, and those children and their families need a name and a net for what they are doing. Nobody likes civil unions anymore except for a few alternative hetero couples, but maybe we can figure out a way forward that does not require us to edit the words ?mother? and ?father? out of our law and cultural dialog.

In the meantime, legal gay marriage *is* the reality in a number of states. With that reality comes some responsibility on the part of those who won. For one thing, you now have a legally recognized family form. That means you get to be studied just like everybody else. You can?t cry ?foul? and ?no fair? when social scientists and social critics cast an eye on your family just as they do any other family form. You won a seat at the table. So don?t go stomping off when someone asks you a tough question.

And, while legal gay marriage is not yet the law of America, the gay marriage movement has certainly won the day in framing their cause as one of openness, justice, and civil rights. Young people especially accept that these are the terms of the debate and they are largely on your side. I respect this language and I believe it is sincere. So here, I believe, is another challenge for those who espouse that language: just as openness and justice is of primary importance for those leading the gay marriage movement, so it is of primary importance amid disturbing social practices to which gay and lesbian would-be parents increasingly turn to have their ?own? children. Use of sperm donation, egg donation, and surrogacy all deliberately deny the resulting child knowledge of and daily life with her or her biological father or mother. Sperm donation commodifies men by turning them into products offered on websites. Egg donation and surrogacy commodify women by turning them into egg banks ripe for harvesting or wombs ready to rent, at real and potentially grave risk to their own health. The gay and lesbian parenting movement can no longer uncritically offer ARTs as one among many ?family building? options without confronting the very troubling class and gender issues rife in use of these technologies.

Finally, I?d like to say something about the Institute for American Values, where I direct our Center for Marriage and Families, where David is founder and president, and where this FamilyScholars blog is based. This Institute has not had in the past, and does not have now, an organizational position on gay marriage. We have had and currently have leaders, staff, board members, and scholars who work with us on projects who take different positions on this question or no position at all. In a very real way, nothing has changed. We are still doing our work, hosting a broad public conversation, moving forward, listening to others, thinking hard. We are still passionate about child well-being, stable families, and the role of marriage as one of our most pro-child social institutions, a thick web crafted over millennia of human experience which at its core seeks to define, bring together, and keep together the parents who made the baby, but which also offers numerous other goods, like dignity, companionship, some kind of social security and more, which it is only human to want. I understand that. I?m listening.

The old layout blocked the way to the bathroom, the new way allows you to pass right next to the line, instead of having to ask to cross the line to the register?just go to the bathroom. ?Even exiting the building is easier because the line to the register is not blocking the front entrance. Lastly,?there is a walkway that?opens up where the old pastry case was, allowing the employees to get your food and drinks out faster. If you notice in this picture below, the drink pick up station is on the right, the signs are color coded & easy to read and the register is on the left, where the old espresso machine used to be. The espresso machine is on the right, behind the drink pickup station. Now all we have to do is make your drink, turn around and set it on the counter for pickup. Simple, Fast & Effifient.

There are even more changes coming that will help us handle the rush! Read on? The New register location is equipped to handle two registers! YES, I Know?. I said TWO REGISTERS!!! How many times have you been in line and thought to yourself, geez, I just want a cup of coffee or I love this comment from Yelp, How Long does it take you order? or have you ever thought to yourself??Wouldn?t it be great to open up another register to help bust through this line???? Well soon, there?will? That?s right, we will be bringing on a second register to help you faster. The old menu was confusing and took a while to read it all. The new Menu is much easy to read and will make the ordering process much faster.?The food menu is basically the same, although added the Hot Food section. If you notice the new menu?s are color coded and easy to read. These changes will help us move faster to provide better service to you?

For our?clients who are going back to work or back to class, I know it will help you manage your time better and still have a relaxing meal. On the weekends, the second register?is a necessity. We realize that you don?t want to wait 10 minutes or longer in line and then another 10 to 15 for your food and drinks. We will try to get you through the line a just a couple of minutes and have your food out to you in 10 minutes or less.

WASHINGTON, July 23, 2012 ? The existence of the Federal Communications Commissions Broadband Lifeline Pilot, and the emergence of national public-private organizations focused on computer training could herald the beginning of a new age of broadband adoption and use, said panelists at the Broadband Breakfast Club last week.

BroadbandBreakfast.com released the video of the event, which included participation by experts from Connect2Compete, the Benton Foundation, Comcast, the National Telecommunications Cooperative Association, the Massachusetts Broadband Institute, and a consultant. The event was moderated by Drew Clark, chairman and publisher of BroadbandBreakfast.com, and also executive director of the Partnership for a Connected Illinois.

The FCC?s National Broadband Plan identified three areas that need to be addressed to getting all Americans online: the cost of broadband, basic digital literacy skills and the relevance of content available over broadband transmission. All three were featured in the discussion at Tuesday?s event.

Children who are obese are more likely to be depressed than those who are undergoing chemotherapy. Depression treatment during childhood represents a potentially reversible cost for insurance companies. UHG conducted their pilot study, the JOIN research study, in a cohort of 150 obese children and adolescents. Participants learned about ?Yes foods? and ?No foods?. 70% of classroom time was devoted to nutrition education, 20% to fitness activities, and 10% to social factors. Participation rate achieved was 84%. UHG and saw remarkable rates of weight loss in children and adolescents enrolled in the study. Within the 13-17 year old cohort, 65% weight loss was achieved. One interesting side effect of this study was that many parents reported losing weight as well, a beneficial side effect of changing family eating and exercise regimes at home. This innovative trial focused on utilizing community groups, school nutrition coordinators, and parental modification of the home environment to reduce obesity in children and adolescents. A primary objective of UHG is to translate the design of this study into a childhood obesity mitigation product, which can be implemented in communities throughout the country.

Mr.?Beauregard?also oversees other innovative trials that focus on reducing healthcare costs incurred through obesity-related complications. A major focus of UHG is to lower the conversion rates of patients from pre-diabetes status to T2DM status. Previous pilot studies have shown that men and women respond differently to different methods of lifestyle intervention. UHG found that women respond quite positively to lifestyle interventions in the form of a group setting. On average, men do not respond well to interventions delivered in the form of a group setting. In response to this, UHG is in the process of producing an on-demand, reality television style intervention.
